WEB SITE PRIVACY POLICY

This document describes the methods used to manage the website http://www.nctm.it (hereinafter, the “Site”) in relation to the processing of personal data of the users who consult the Site.

This information is provided pursuant to Section 13 of Legislative Decree no. 196/2003 – Personal data protection code (hereinafter, the “Code”). This Privacy Policy must be considered as referred and hence applicable only to the Site and to the services offered by the Data Controller through the same, and do not extend to pages or websites which may be accessed via links and managed by third parties. Therefore, each user should carefully read the relevant privacy policies in order to better understand how data are processed through such websites.

  1. THE DATA CONTROLLER

When navigating the Site, data concerning identified or identifiable users may be processed.

In compliance with the provisions of Section 28 of the Code, the Data Controller is Nctm Studio Legale, with registered office in via Agnello 12, Milan (hereinafter “Nctm” or the “Data Controller”).

  1. WHERE AND HOW DATA ARE PROCESSED

Data relating to the web services of this Site are processed at the offices of the Data Controller and are handled by internal technical personnel, specifically appointed in writing as Person in charge of the processing, pursuant to Section 30 of the Code and/or by personnel outside the Data Controller’s organisation, duly appointed, in writing, as Person in charge of the processing, pursuant to Section 29 of the Code.

All personal data are processed both in paper format and, mainly, in electronic format. Data will be stored in a form that allows the identification of the user only for the time strictly necessary to achieve the purposes for which they were originally collected and, in a any case, within the limits provided by law. Specific security measures are observed to prevent the loss of data, their unlawful or improper use and unauthorised accesses to the data, in compliance with the provisions of the Code and, in particular, of Annex B thereto.

In order to assure that personal data are always accurate, updated, complete and pertinent, data subjects are kindly requested to report any changes therein to the following e-mail address: info@nctm.it.

  1. PURPOSES OF THE PROCESSING

Personal data are processed by the Data Controller within the limits and only for the purposes to provide services accessible via the Site and in particular to:

  • allow users to be acquainted with and examine in depth the activities, events and other, institutional and training, initiatives organised and carried out by the Data Controller;
  • manage and develop, with regard to the previous point, questions and requests for interaction with Nctm, its professionals and entities within the organisation of the Data Controller;
  • offer a platform of scientific insights, through the contributions proposed by Nctm;
  • mange the registration and authentication of those who are authorised to access the reserved areas of the Site;

The carrying out of the activities listed above does not require the users’ consent, being the services or performances, in most cases, carried out at the direct request of the parties concerned.

So, the failure to provide certain data (personal details, e-mail address, mail address and telephone number, etc.) may prevent the Data Controller from providing the requested services.

Personal data provided by users submitting contact requests are used for the sole purpose to provide the requested service or performance and may be disclosed to third parties only in the event that this is necessary for such purpose (e.g. consultants, partners, agents, etc.).

The user may decide to subscribe to Nctm newsletter by giving his/her consent, where applicable, in compliance with the provision issued by the Italian Data Protection Authority (hereinafter, the “Garante”) of 4 July 2013, containing “Guidelines on promotional activity and spam fighting”.

Consent, when given through the specific forms, may be withdrawn at any time, even only for certain of the mentioned information and promotional contact methods (traditional or automated).

  1. TYPES OF DATA PROCESSED
  1. Navigation data

The IT systems and software procedures set up for the correct functioning of this Site collect, during their normal operation, certain personal data, which are transmitted in the context of the use of Internet communication protocols.

Said data are not collected in order to be associated with identified persons, but may, on account of their nature, allow users to be identified through processing and associations with other data held by third parties.

This category of data includes IP addresses or the domain names of computers used by persons accessing the site, URIs (Uniform Resource Identifiers), the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the digital code indicating the state of the server’s response (successful, error, etc.) and other parameters relating to the operating system and to the user’s IT environment.

These data are used for the sole purpose of obtaining anonymous statistical information on the use of the Site and to verify its correct operation and are deleted immediately after processing. The data may be used to ascertain responsibility in the event of any IT crimes against the Site.

  1. Data provided voluntarily by users

The optional, explicit and voluntary submission of an e-mail address to the addresses indicated on this Site, as well as the transmission of messages through the published collection forms, results in the collection of the sender’s address, of other personal data that may be included in the request, which are necessary for responding to requests. Specific summary reports may be shown or displayed, from time to time and when strictly necessary, on the pages of the Site dedicated to particular on-demand services.

  1. CIRCULATION OF DATA

Data will not be circulated or assigned to third parties unless with the express and specific consent of the data subject.

Should it be necessary, for organisational and administrative reasons or as required to support the services provided, to disclose the data to third party suppliers or partners of Nctm, the Data Controller will appoint the latter as persons in charge of the processing, by virtue of their proven skill, experience and reliability.

It is understood that the users’ personal data may be freely disclosed to third parties, such as police bodies, every time this is allowed by law or required by decision or order of a competent authority.

Personal data of the users of the Site will not be transferred abroad, to those countries not belonging to the European Union and not assuring proper levels of protection of the personal data. Should this be necessary for the purposes of the provision of the requested service, the Data Controller will request a specific consent to the data subject or will act anyway in compliance with the applicable law and regulations.

  1. LINKS TO OTHER WEB SITES

The Data Controller does not check and cannot supervise the content, or personal data processing policies, of third parties’ website and services accessible via the links contained in the Site. Therefore, Nctm, may in no way be deemed responsible for processing operations carried out through or in relation to said third parties’ websites.

Hence, users should pay the greatest attention in such respect and read carefully the conditions of use and privacy polies published on the visited websites.

  1. RIGHTS OF THE DATA SUBJECTS

Data subjects have the right to obtain at any time confirmation of the existence or non-existence of data concerning them and to be informed of their content and source, to verify their accuracy or request their integration, updating or correction, pursuant to Section 7 of the Code.

In accordance with said Section, data subjects have the right to request the deletion, transformation into an anonymous form or the blocking of data processed in breach of the law, as well as to oppose, for lawful reasons, their processing.
